Niusleters Privacy Policy
This Privacy Policy will also provide information so that you may give your explicit and informed consent to the processing of your personal data, where applicable.
As a general rule, any information or data you provide to Niusleters will be processed lawfully, fairly, and transparently by the platform. To this end, internationally recognized principles governing the processing of personal data are taken into account, such as purpose limitation, storage limitation or minimization, data quality, and data confidentiality.
From this point forward, Niusleters refers to both the website and the application, as well as the newsletter associated with them.
1. Data Controller
Niusleters, as identified at the top of this Privacy Policy, is the controller of the Personal Data processed through the platform. You may contact the persons responsible at the following address: hola@niusleters.com.
2. Personal Data Processed
When you use Niusleters, you may provide us with or we may collect some of your Personal Data, which may vary depending on the profile from which you access, such as first and last name, email address, identification number, or tax address.
Niusleters may collect your Personal Data both when you choose to provide it (for example, when you request information through the "Contact" section of the website, when you subscribe to the newsletter, or when you access the platform) and when analyzing your use of the website.
The Personal Data that may be processed is as follows:
a. Name and email address
When you subscribe to the Niusleters newsletter, when you contact us through the Contact section, or when you register on the platform, you will be asked to submit information such as your name or email address. In addition, whenever you communicate with Niusleters using the contact details provided on the website, we may collect any additional information you choose to provide.
b. Special categories of personal data
In certain areas of the platform, there is other personal data that we may need for its proper functioning. In the Brands section, this data includes your first and last name, an identification number, and a physical address, in order to issue invoices; in the Niusleters section, on the other hand, we will need to know whether VAT and income tax withholding should be applied to your invoices.
In other parts of the websites, such as in contact forms, chat, or even in the "My Brands" or "My Niusleters" sections, there are free text fields in which you could provide information (consciously or unconsciously) that may contain Personal Data, such as data revealing political opinions, religious or philosophical beliefs, etc. We urge you not to disclose this type of data unless you consider it absolutely necessary. Please note that, as required by applicable law, sensitive categories of Personal Data may only be processed with your explicit consent. Niusleters emphasizes the importance of you expressing your explicit consent to process this type of Personal Data, should you choose to share it.
c. Data voluntarily provided by the data subject
As mentioned in the previous section, certain areas of Niusleters allow you to publish different types of content to which the platform will have access and which may include Personal Data relating to other persons.
Whenever you choose to share Personal Data relating to other persons, you will be considered an independent data controller with respect to that Personal Data and must assume all inherent legal obligations and responsibilities. This implies, among other things, that you must indemnify Niusleters, as and to the extent necessary, against complaints, claims, or demands for damages that may arise from the processing of such Personal Data and that may be filed by those persons whose information you have provided through Niusleters.
In any case, if you provide or process Personal Data of a third party when using Niusleters, you hereby guarantee that such processing is based on the consent of the third party in question or that you have another legal basis that legitimizes the processing of third-party Personal Data. You also assume all responsibility associated with such actions.
d. Data automatically collected when sending emails or other communications
When we send emails or other communications, we use tracking systems -- with the explicit and free consent of the user -- such as pixels or web beacons, in order to detect whether messages are opened, whether hyperlinks contained in the emails are clicked, from which IP address or with which type of browser the email is opened, and other similar matters.
e. Browsing data
The operation of Niusleters, as is typically the case with any Internet website, involves the use of computer systems and software procedures that collect information about users as part of their routine operation. Although Niusleters does not collect this information to link it to specific users, it is possible to identify those users either directly through such information or through the use of other collected information. As such, this information must also be considered Personal Data.
This information includes various parameters related to your operating system and IT environment, including your IP address, your location (country), your computer's domain names, Uniform Resource Identifiers (URIs) of resources requested on Niusleters, the time of requests made, the method used to submit requests to the server, the size of the file obtained in response to a request, the numerical code indicating the status of the server's response ("successful," "error," etc.), and other parameters related to the user's operating system and IT environment.
This data is used to compile statistical information about the use of Niusleters, as well as to ensure its proper functioning and to identify any failures or abuse that may occur. Except for this latter purpose, this data will not be retained indefinitely.
f. Cookies
Cookies are small text files that the websites you visit may send to and store on your computer, to then be sent back to those same websites when you visit them again. Through the use of cookies, websites can "remember" your actions and preferences -- such as login data, chosen language, font size, other display settings, etc. -- so that you do not have to provide that information again when you return to the site or browse through its different pages.
Cookies are used for electronic authentication, session tracking, and storing information about your activities while using a website. They may also contain a unique identification code that enables the tracking, for statistical or advertising purposes, of your browsing activities within a website.
While browsing a website, you may also receive cookies from other websites or web servers ("third-party cookies").
There are various types of cookies, each with different characteristics and functions. Additionally, the length of time they remain on your computer may vary. "Session cookies," for example, are automatically deleted when you close the browser; however, "persistent cookies" remain on your device for a predetermined period of time.
It is possible that, in accordance with applicable law, your consent may not always be required to use cookies on a website. Specifically, "technical cookies" generally do not require such consent. These are cookies used solely to transmit messages over an electronic communications network or that are necessary to provide the services you request. In other words, these cookies are essential for the operation of the website or necessary to carry out the activities requested by the user.
On the other hand, "profiling cookies," such as those intended for creating user profiles and used to send advertising messages tailored to the preferences expressed by users while browsing the web, generally do require user consent, although this may vary depending on applicable law.
Types of cookies used
Niusleters uses the following types of cookies, which can be deselected (this does not include third-party cookies, whose selection or deselection should be consulted through the relevant links):
- Navigation or session cookies: necessary for the operation of Niusleters or to allow the use of the content and Services of the Websites.
- Analytical cookies: analytical cookies help Niusleters understand how visitors use the different pages and track traffic to or from Niusleters. These cookies do not collect Personal Data or information about your identity. The information is processed as aggregated and anonymous data.
- Functionality cookies: used to activate specific features of Niusleters and to configure pages according to your preferences, in order to improve your experience.
- Profiling cookies: used to examine the preferences you reveal through your use of the website and to send you advertising communications tailored to those preferences.
Niusleters also uses "third-party cookies," that is, cookies from websites/web servers owned by third parties and distinct from our pages. These cookies also include profiling cookies. These third parties will act as independent data controllers of the data collected through the cookies they send or as data processors for Niusleters.
Cookie settings
Through your browser settings, you can block or delete all or some of the navigation and functionality cookies used on the Websites.
If you do not allow the use of functionality cookies, this may cause some services or certain features of Niusleters to be unavailable or to not function properly, and you may be required to manually modify or enter certain information or preferences each time you visit the platform.
Your cookie preferences will be reset if different browsers are used to access Niusleters.
How to view and modify cookies in your browser
Please refer to the following instructions for more information on how to configure your browser's cookie preferences:
If you do not use any of these browsers, select "Cookies" in the corresponding section of the manual to find out where your cookie folder is located.
WARNING: If you block or delete the technical or functionality cookies used by Niusleters, you may be unable to browse the platform, certain services or features may become unavailable, or errors may occur.
3. Purpose of Data Processing
Niusleters will use the Personal Data collected through the Websites for the following purposes:
- To provide services such as: allowing you to create and maintain a registered user profile, verifying your identity, and assisting you in the event that you lose or forget your login credentials or password, responding to information requests you submit through the "Contact" section, and providing any other service you may request.
- For future promotional and advertising purposes, including direct marketing, market research, and surveys, whether by email, through push notifications/pop-up banners, by instant messaging, or through Niusleters' official social media channels. Also for promotional activities in their broadest sense, which may include games, contests, or events with prizes, products, or services related to the company or to third-party products and services ("Promotion").
- For promotional emails about products and services identical or similar to those you may have previously purchased ("Soft Spam").
- To create your user profile through the use of profiling cookies ("Profiling"), provided you have given your consent.
- To comply with laws that require Niusleters to collect certain Personal Data or to further process it ("Compliance").
- To prevent and detect any misuse of Niusleters or any fraudulent activity that may be carried out through the platform ("Misuse/Fraud").
4. Legal Bases for Processing
The following are the legal bases under which Niusleters processes your Personal Data for the purposes detailed in Section 3:
- Provision of services: processing for these purposes is necessary to provide the service and is therefore necessary for the performance of a contract or for the implementation of pre-contractual measures. You are not required to provide your Personal Data for these purposes; however, if you do not, Niusleters will be unable to provide you with any service.
- Promotion: processing for these purposes is subject to user consent. You are not required to give Niusleters your consent for the use of your Personal Data for these purposes. You may revoke any consent you have given at any time (see Section 8 for more information).
- Soft Spam: processing for this purpose is based on the interest of Niusleters in sending you direct marketing emails about products and services identical or similar to those you have already been able to purchase through the platform. You can block these communications through the link found at the bottom of each communication.
- Profiling: processing for this purpose is subject to your consent, which you will provide through the cookie pop-up banner. You may revoke any consent you have given at any time (see Section 8 for more information).
- Compliance: processing for this purpose is necessary for Niusleters to fulfill its legal obligations.
- Misuse/Fraud: the information collected for this purpose will be used solely and exclusively to prevent or identify any fraudulent activity or any misuse that may occur on Niusleters, so that it may defend itself in any legal proceedings.
5. Recipients of Personal Data
Your Personal Data may be shared with the following persons/entities ("Recipients"):
- Entities that typically act as Data Processors, namely: I) Persons, companies, or professional firms that provide assistance or advice to Niusleters in accounting, administrative, legal, tax, financial, or credit recovery matters; II) Persons authorized to carry out technical maintenance work (including the maintenance of network equipment and electronic communications networks).

- Persons authorized by Niusleters to process the Personal Data necessary for carrying out activities strictly related to the provision of the Services.
- Entities, bodies, or authorities to which your Personal Data may be disclosed, in accordance with applicable law or binding orders from such entities, bodies, or authorities.
6. Personal Data Transfers
Some of your Personal Data may be transferred to certain Recipients. Niusleters guarantees that the processing of your Personal Data by these Recipients will be carried out in accordance with applicable law and that the necessary protective measures are applied to ensure the legality and security of such Personal Data transfers.
You may request further information from Niusleters in writing about such transfers at the following address: hola@niusleters.com.
7. Personal Data Retention
Niusleters will retain Personal Data that has been processed for the Provision of Services for the period deemed strictly necessary to fulfill such purposes. In any case, since this Personal Data is processed in order to provide certain Services, Niusleters may continue to store such Personal Data for a longer period if necessary to protect the interests of Niusleters.
Niusleters will retain Personal Data that has been processed for Promotion or Profiling from the moment you give your consent until you revoke it. Once consent is revoked, the Personal Data will no longer be used for these purposes, although Niusleters may continue to retain it if necessary to protect its interests.
Niusleters will retain Personal Data that has been processed for Soft Spam until you object to such processing through the link found at the bottom of each email.
Personal Data processed for Compliance purposes will be retained for the specific period of time required by applicable law or the relevant legal obligation.
Niusleters will retain Personal Data that has been processed for the purpose of preventing Misuse/Fraud for the time strictly necessary to fulfill the purposes for which it was collected.
